Ordinance Overview

The Village of Oregon Open Burn Ordinance (Ordinance No. 18-05) primarily aims to regulate outdoor and open burning for safeguarding life and property from fire hazards and preventing nuisance conditions.

Key Rules:

  1. General Prohibition: Outdoor and open burning is largely prohibited, except as specifically allowed in the ordinance.

  2. Electric Grills: Not subject to the restrictions of this ordinance.

  3. Campfires and Cooking Fires:

    • Must be in specified devices like fire pits, homemade fireplaces, or commercial fireplaces.
    • Need to maintain a distance of 15 feet from buildings, structures, lot lines, or combustible materials (10 feet for UL-approved devices).
    • Not allowed on combustible decks and porches, but allowed on non-combustible patios with certain restrictions.
    • No use of flammable liquids like gasoline for ignition or storage near fires.
    • Fires should not cause visible smoke beyond the property line; if so, they may be extinguished by the Fire Department.
    • Fire extinguishing methods must be readily available.
    • Supervision by a person over 18 years of age is required.
    • Complete extinguishment of fires before leaving them unsupervised.
  4. Grills and Open Flame Cooking Devices:

    • To be used 10 feet away from buildings, structures, or lot lines.
    • Restrictions on operation on combustible decks or balconies.
    • Proper disposal of used charcoals and ashes.
    • Storage of LP gas containers and grills.
  5. Deep Fryers: Not to be used within 15 feet of any building, structure, lot line, or combustible materials.

  6. Prairie Restoration Fires: Permitted under the supervision of professionally trained individuals and specific approval from the Fire Chief or designee. Please complete this paper form and submit it to the Fire Department.

  7. Local Conditions: Fire Chief or designee can prohibit burning due to hazardous atmospheric conditions or local circumstances.

  8. Enforcement and Penalties: Enforced by the Fire Chief or designee, residents are subject to a fine if they are unable to maintain, control and extinguish fires that they oversee. To review Resolution #20-003, click here

  • Burn permits will not be issued on days when the DNR declares the fire danger in Dane County to be high, very high, or extreme, as indicated on this link.

Grills, Campfires, and Cooking Fires

No permit is needed for a grill, campfire, or cooking fire.

A campfire is no larger than 3 feet wide, 3 feet long, and 3 feet tall. A campfire must also only use dry firewood and cannot be accelerated with things like gasoline. 


Burning something other than a campfire:

If you are looking to burn something other than a campfire it is prohibited. Burning something other than a grill/campfire/cooking fire is subject to Resolution #20-003.
