Ordinance Overview

The Town of Dunn Burn Ordinance (Ordinance No. 16-3, Amended June 15, 2020) principally seeks to regulate outdoor and open burning, as well as the use of outdoor furnaces, within the town. This ordinance is designed to protect the community from air and water pollution, reduce fire hazards, and prevent nuisance conditions arising from uncontrolled or inappropriate burning practices.

Key Rules:

    1. Open Burning Prohibition: No open burning is allowed within the Town of Dunn, except as exempted in Section 5 or regulated in Section 6.

    2. Outdoor Furnaces: These must be installed and used in accordance with specific guidelines, including distance from buildings, chimney height, and adherence to EPA emission standards.

    3. Prohibited Materials for Burning: Includes rubbish, garbage, waste oil, asphalt, treated wood, plastics, rubber, and certain recyclables.

    4. Permit and Notification Requirements: A burn permit is required and must be obtained by filling out the form below on the day of the burn.

    5. Time and Weather Restrictions: Burning is only permitted on even-numbered days, between one hour before sunrise and one hour after sunset or 7:00 PM, whichever is later. Burning is not allowed when wind velocity exceeds 15 mph or if it causes nuisance due to smoke or odor.

    6. Distance Regulations: Burning in a barrel or fire pit must be at least 15 feet from property lines and 30 feet from any building, fence, or combustible material.

    7. Penalties for Violation: Violations can result in fines ranging from $20 to $500, plus the costs of prosecution.

  • Burn permits will not be issued on days when the DNR declares the fire danger in Dane County to be high, very high, or extreme, as indicated on this link.
